Information pursuant to Article 13 of Legislative Decree no. 196/2003 on „Protection of Personal Data“
In accordance with § 13 of Legislative Decree no. 196/2003 we are providing the following information: 1. The personal data supplied by or acquired from you in the context of our activity will be processed according to the principles of correctness, legality, transparency and protection of your privacy and rights. 2. The processing of the personal data is for the purposes of meeting contractual obligations or is due to an order by the data subject. 3. Processing may also be accomplished using electronic means in a way that guarantees the security and confidentiality of the data. 4. Provision of the data is obligatory. Refusal to supply to us with all or some of your personal data or to permit processing of the data may mean non-performance or only partial performance of the contract, i.e. the non-execution of the order. 5. The data may, solely for the above-mentioned purposes, be communicated to certain persons, among them legal or tax advisers, banks and haulage companies, in order to meet the above-mentioned obligations. Knowledge of the data may be gained by other persons who are processing it or manage its processing. The personal data processed will in no circumstances be distributed further. 6. Data classified as sensitive personal data, i.e. data on racial or ethnic origin, religious, philosophical or other convictions, political opinions, membership of parties, trade unions, religious, philosophical, political or trade-union associations or organisations, as well as personal data regarding health and sexual life may be processed with the written permission of the data subject (where provided for) and with the authorisation of the national data protection body (Article 13 of Legislative Decree no. 196/2003), in the manner and for the purposes as stated above. 7. The processor of the personal data is Securplan GmbH, whose registered office is located at Kravoglstrasse 32/34 - 39012 Meran, ITALY. Mr Anton Gögele is a processing manager for personal data. 8. You may also enforce your rights against the processor or the processing manager as provided for in � 7 of Legislative Decree no.196/2003, which we quote here for your information in full: § 7 Right of access to personal data and other rights 1. The data subject is entitled to receive confirmation of the presence or otherwise of any personal data concerning him or her, even where such data is not recorded, and that such data be made available to data subject in comprehensible form. 2. The data subject is entitled to receive the following information: a) origin of the personal data; b) purpose and manner of the processing; c) system employed for processing using electronic means; d) data for the identification of the data owner, manager and representative appointed under § 5 (2); e) persons or groups of persons to whom the personal data may be communicated or who may gain knowledge of such data as the appointed country representative, manager or processor. 3. The data subject is entitled to the following: a) the updating, correction or, if he or she expresses interest, the completion of the data; b) the deletion, conversion into anonymous form or blocking of improperly processed data, including data whose storage is not necessary for the purposes for which the data has been gathered or processed; c) confirmation that the steps under a) and b) have been communicated (including in regard to their content) to the person to whom the data has been sent, unless this is impossible or disproportionately costly in view of the rights being protected. 4. The data subject is entitled to oppose, in whole or in part: a) the processing of the personal data that concern him or her where good cause exists, even if the data meets the purpose of the collection; b) the processing of personal data that concern him or her for the purpose of sending advertising or direct sales material or for market research or sales communication purposes.
